WARRANTY:

TISD’s standard warranty is 1 year parts and labor and is included in the quoted price.  Extended warranties can be purchased at an additional cost.

TERMS AND CONDITIONS:

I.     Inspection and Acceptance Criteria

Inspection and acceptance of any materials shall consist of a physical inventory conducted by a customer representative who will visually inspect the items received for shipping damage.  The inspection of the product shall be conducted within three business days of receipt.  Customer shall notify SAIC within 3 business days, in writing if, upon receipt of materials, there appears to be any claim for shortage or shipping damage.  If a written claim is not submitted to SAIC within the 3 business days, the merchandise will be deemed received complete and accepted.  Individual discrepancies shall be cleared and/or witnessed by a representative of Customer.  Any discrepancies discovered during the inspection of the inventory shall be corrected as soon as possible.

II.     Delivery

Standard lead-time is either 90- or 120-days After Receipt of Order (ARO); shipping is F.O.B. Destination CONUS.
 

III.     SAIC Warranty for Standard Products and Returned Material Authorization (RMA)

SAIC provides a one-year warranty against defects in materials and workmanship.  SAIC will, at its sole discretion, repair or replace any product within one year of sale date, which is examined and determined to be defective.  All returns shall be sent to SAIC’s Sterling Integration Facility: 45472 Holiday Drive, Suite 7 , Sterling , VA 20166 .  Shipping expenses will be the sole responsibility of the buyer.

SAIC’s liability under this warranty shall be limited to the repair or replacement of the defective unit.  In no event shall SAIC be responsible for collateral or consequential damages.

Returned units shall require an RMA (returned material authorization) number available from SAIC’s website http://www.tacinfosys.com/asp-pages/warranty/warranty.html

Returned units will not be accepted without both an RMA number and a copy of the Purchase Order.  SAIC shall retain the right to utilize refurbished materials to complete any repair/replacement.  All returned units should be repaired/replaced within 120 days from receipt of defective unit.  Any warranty/repair shall not extend the original one-year warranty period from date stated on Purchase Order, except as provided below.  

This warranty does not cover units, which are defective due to misuse, abuse, improper installation, neglect, improper shipping, damage caused by disaster, improper electrical current, or improper use of software.

This warranty does not cover units which have been altered or repaired by anyone other than SAIC’s Sterling Integration Facility.

This warranty does not cover consumables such as fuses, lamps, etc.

If a claimed defect cannot be identified or replicated at SAIC’s Sterling Integration Facility, buyer will be responsible for all costs incurred.

Hardware Warranty
SAIC expressly warrants the products provided as meeting the applicable SAIC product specifications.  SAIC makes no other warranties, either express or implied (including, without limitation, warranties as to merchantability or fitness for a particular purpose).  Purchaser retains responsibility for the application and functional adequacy of the offering.  In addition, the following shall constitute the exclusive remedies for any breach by SAIC of its warranties hereunder:  SAIC warrants that all products provided under this contract shall be free from defects in material, workmanship, and title.  SAIC agrees to either replace or repair, free of charge, any such product, component, or part thereof which shall be returned to the nearest authorized repair facility, provided that the defect is discovered within 1 year from date of delivery; transportation charges for return to repair facility prepaid by purchaser. Return transportation to purchaser shall be at SAIC expense.  Any product or component, or part thereof so replaced or repaired shall be warranted by SAIC for the remainder of the original warranty period or 3 months, whichever is longer.  Any and all such replacements or repairs necessitated by inadequate preventive maintenance, or by normal wear and usage, or by the fault of purchaser, shall be at purchaser's expense.  

IV.     Disclaimer or Implied Warranties

The express warranties, if any, are the sole and exclusive warranties provided by SAIC.  SAIC specifically disclaims any other warranties, express or implied including but not limited to warranties of merchantability or fitness for a particular purpose as well as any warranties alleged to have arisen from custom, usage, or past dealings between the parties.
